The Insurance Company Wants to Settle My Case. Should I Settle?

There are many factors you would want to take into consideration. The most important one is have you fully healed from your injuries? If you have, you would be in a better position to be able to negotiate your claim with an insurance claim adjuster. Generally speaking it is not a good idea to negotiate your own claim. This is because you do not know the valuation of your case and would likely settle your case for far less than what its worth.

Another important factor is whether you will require future treatment. If you do require future treatment you would be entitled to compensation for that. It is important to have your doctor write a note about your future care and the costs that may be associated with that so that you could get compensated for it.

Another factor is whether your injuries is going to cause you to lose pay in the future. Legally, this is called loss of earnings capacity. If that is the case, you would want to make sure you account for that.
