The Unruh Civil Rights Act (Unruh Act, Civil .Code. §51) guarantees every person in California “full and equal” access to “all business establishments of every kind whatsoever” and imposes a duty on business establishments to serve all persons without arbitrary discrimination.
To bring a claim under the Unruh Act The Plaintiff has the burden to prove that:
1. He/She has been a victim of Discriminatory Conduct;
2. By a Proper Defendant (i.e. a “business establishment”) business establishments are defined very broadly and include places such as: (1) places of public accommodation or amusement; (2) public schools and (3) with some exception nonprofit organizations;
3. He/She is a member of a protected class.
a. Some of the recognized protected classes include:
iv. Medication condition;
v. Marital status;
vi. Sexual orientation.
4. And that the establishment denied access to “accommodations, advantages, facilities, privileges, or services.”
