Is What the Insurance Company Offering Me the Right Value for My Case?

The value of your case is in my mind is tied to several factors. But the most important of which is: How has the injury impacted your life?

When clients come to me, I take my job extremely serious and make sure that they are fully compensated by the insurance company. And if the insurance companies are not willing to settle for what I believe is full value, then I would counsel my clients on their options, including trial.

None of the clients are excited about going to trial, however, depending on the injuries it may be a necessary thing to do to get FULL Justice.

Generally speaking insurance companies’ offer are much lower than what you may be able to get at a trial. Of course, there are many risks of going to trial and you need to have an attorney, such as myself, who has gone to trial to be able to give you a full evaluation.

The reason why the insurance companies do not offer full value on your case is simple. They look at you as a burden. The way they value cases is they punch in your injuries and medical bills into a computer that spits out a number. And then, as your case moves along they are afforded leeway to increase their offer. This is because insurance companies are assessing the value of your health based on risk. As your case gets closer to trial, the risk goes higher and so they generally offer you more money.

Of course, many other factors go into play. One of the important one’s is the attorney who is representing you. Insurance companies have a data base that tells them which firms and attorneys try cases and which don’t. The one’s that don’t get a significantly less settlement.

Next time, you are considering settling your case, make sure you are comfortable with the amount of money you are getting. A settlement is a one time thing, and you will not be able to go back later and ask for more money. This is especially true if you have an injury that is going to be lingering for some time or is life long.
